Having determined that even after the second round of cap selections this past summer there are still insufficient approvable H-1b petitions to meet the fiscal 2022 cap, US Citizenship and Immigration Services (USCIS) has conducted a third cap selection process form the original entry pool.

For those cases selection, there will again be a ninety-day filing window – now from November 22, 2021 to February 23, 2022. Freshly selected entries will now have to submit a full petition during this period, which would need to be approved by USCIS to secure an H-1B to the individual under the cap.
