USCIS Publishes Proposed Rule implementing $10 H-1B Lottery Entry Fee Per Petition

USCIS has published a proposed rule implementing a $10 fee for each H-1B lottery entry.  This is separate from the various government processing fees payable upon filing of a complete petition (Filing Fee, Fraud Detection/Prevention Fee, Education/ACWIA Fee, Premium Processing Fee), and represents the first time a petitioning employer would need to pay the government anything even if its petition is not selected in the lottery.

 

The fee is per-entrant, not per-company – so a company filing three petitions would need to pay $30.00 rather than a one-time $10 fee.
