DOL Provides Guidance on PERM Labor Certifications

The US Department of Labor (DOL), through it’s Office of Foreign Labor Certification’s (OFLC), has announced a plan to send approved PERM labor certifications electronically.  PERM is the first stage of most employment-based permanent residence cases.

As of March 25, 2020, DOL went live with a system for sending certified PERM applications by email. This system will remain in place through June 30 of this year.

Currently, an e-mail is first sent to inform employers and attorneys that a case has been certified.  It sounds like this first e-mail will still be sent. The system as it existed then involved sending a certified copy of the original filing to the attorney of record in hard copy by mail. Now, a certified copy of the PERM filing will now be sent by a separate e-mail, which DOL is endeavoring to send same-day.
