DOL Changeover to FLAG for PERM Labor Certification Filings Confirmed, Linking of Prevailing Wage Requests to PERM Applications

The US Department of Labor (DOL) has reiterated the official changeover date for PERM labor certifications filings as June 1, 2023.  On Mary 31, 2023 at 6:59pm, the legacy PERM system will be shut down for submission of new applications electronically (it will remain online for activity on previously-filed cases, however, including help-desk functions as well as audit responses, reconsideration or appeal requests, and withdrawals).  Applications prepared in the legacy system and printed may be filed by mail as long as postmarked by May 31, 2023.

The DOL’s Office of Foreign Labor Certification (OFLC) had earlier announced a delay to the transition date to the FLAG system, and has used the extra time to create functionality where a Prevailing Wage determination can be linked to a PERM even if prepared in an account to which the user no longer has access.
