Several Organizations File Suit to Force Administration to Implement International Entrepreneur Parole Rule

A group of plaintiffs which includes the National Venture Capital Association (NVCA) as well as a group of entrepreneurs and startups have filed suit against the administration’s actions in delaying, and potentially rescinding, the Obama-era International Entrepreneur Parole Rule which was supposed to have taken effect July 17, 2017. The Plaintiffs are represented by the American Immigration Council and Mayer Brown LLP.
We had discussed the original rule here and the administration’s actions to delay implementation here.
The plaintiffs are arguing that because DHS did not solicit advance comment from the public on the delay, it violated the Administrative Procedure Act’s requirements.
